The text of the 13th Amendment to the Constitution ends slavery and involuntary servitude "except as a punishment for crime whereof the party shall have been duly convicted."  Authors, such as Michelle Alexander, have drawn the link between the incentive this gives states to increase prison populations as an unpaid, virtually enslaved, workforce and the disproportionate arrest and conviction of Black people, the formerly enslaved.

According to the Bureau of Justice Statistics, police threaten or use force against communities of color at greater rates than used against whites.  There is a consensus among those surveyed across race and political affiliation that incidents such as the police killing of George Floyd in 2020 are indicators of larger systemic issues with policing.
